Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Scramage ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. We will indicate the effective date at the top of this page.

2. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and 18, you may use the App only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.

By using the App, you represent that you meet these age requirements.

3. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal mobile device for personal, non-commercial entertainment purposes, subject to these Terms.

You may not:

• Copy, modify, or distribute the App or its content
• Reverse-engineer, decompile, or disassemble the App
• Use the App for any commercial purpose
• Circumvent any security or access-control features
• Use automated tools to interact with the App

4. User Content

4.1 Your Photos

You retain full ownership of photos you select from your device to create puzzles. The App processes your photos locally on your device to create tile-based puzzles.

When you choose to share a puzzle with another player, you grant us a limited, worldwide, royalty-free license to host, transmit, and display the puzzle image solely for the purpose of delivering the shared puzzle to the recipient. This license expires when the shared puzzle is automatically deleted (30 days after creation).

4.2 Content You Share

You are solely responsible for the content of any photos you share through the App. By sharing a puzzle, you represent and warrant that:

• You own the photo or have the right to share it
• The photo does not infringe any copyright, trademark, or other intellectual property right
• The photo complies with the Content Guidelines below
• You have obtained consent from any identifiable people in the photo

4.3 Sender Controls

When sharing a puzzle, you may enable restrictions that prevent the recipient from saving the solved image to their device gallery. When save restrictions are active, the App also blocks screenshots on the puzzle screen. These controls are provided as a convenience; we cannot guarantee that all capture methods are prevented on all devices.

5. Content Guidelines

You must not share photos or content that:

• Contain nudity, sexual content, or pornography
• Depict violence, gore, or graphic injury
• Include hate speech, slurs, or content that promotes discrimination
• Exploit, endanger, or depict minors in any harmful or inappropriate context
• Contain illegal content or promote illegal activities
• Harass, bully, threaten, or intimidate others
• Infringe on the intellectual property or privacy rights of others
• Contain malware, spam, or deceptive content

We reserve the right to remove any content that violates these guidelines and to suspend or terminate access for users who repeatedly violate them.

6. Content Reporting and Moderation

If you receive a shared puzzle containing inappropriate or harmful content, please report it to us at:

Include the share link or token if available. We will review reports promptly and take appropriate action.

We do not pre-screen shared content but reserve the right to monitor, review, and remove content at our discretion.

7. Copyright and DMCA

If you believe that content shared through the App infringes your copyright, please send a notice to:

Your notice should include:

• Identification of the copyrighted work
• Identification of the infringing content (share link or token)
• Your contact information
• A statement that you have a good-faith belief the use is not authorized
• A statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf
• Your physical or electronic signature

We will respond to valid DMCA notices by removing the identified content.

8. In-App Currency

The App may include virtual currency ("coins") that can be earned through gameplay or acquired through in-app purchases. Coins have no real-world monetary value and cannot be exchanged for cash, refunded, or transferred between users.

We reserve the right to modify coin pricing, earning rates, and the features available for coin expenditure at any time.

9. Intellectual Property

The App, including its design, code, graphics, sounds, animations, and all related intellectual property, is owned by Scramage and protected by copyright, trademark, and other intellectual property laws.

The Scramage name, logo, and associated branding are trademarks of Scramage. You may not use them without our prior written permission.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not endorse, guarantee, or assume responsibility for any content shared by users.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCRAMAGE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you have paid us in the 12 months preceding the claim, or $10, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Scramage and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, content you share, your violation of these Terms, or your violation of any third party's rights.

13. Termination

We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may stop using the App at any time by uninstalling it. Upon termination, your license to use the App ends immediately. Shared puzzles already in transit will be deleted according to the normal 30-day retention period.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.

15. General

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scramage regarding the App.

Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment: You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
